Terms of service

I. Definitions
For the purposes of these Terms of Service, the following terms shall have the meanings set out below:
1. Customer – a natural person, legal person, or organizational unit without legal personality to which the law grants legal capacity, placing an Order via the Online Store.
2. Consumer – a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity, within the meaning of Article 22¹ of the Civil Code.
3. Civil Code – the Act of 23 April 1964 – Civil Code (Journal of Laws of 2025, item 1071).
4. Terms of Service – this document setting out the rules for the sale of Goods and the provision of electronic services via the Online Store.
5. Online Store (Store) – the website available at www.esencjazapachu.com.
6. Goods – products offered in the Online Store.
7. Sales Agreement – a distance sales contract for Goods concluded between the Seller and the Customer.
8. Order – a declaration of intent by the Customer aimed directly at concluding a Sales Agreement.
II. General provisions
1. These Terms of Service define the rules for using the Online Store and the conditions for providing electronic services.
2. The Terms of Service constitute a document referred to in Article 8 of the Act on the Provision of Electronic Services.
3. The Online Store is operated by Tomasz Parzybót, conducting business activity under the name EUROTOM Tomasz Parzybót, with its registered office at ul. Olimpijczyków 13a, 42-600 Tarnowskie Góry,

4. These Terms of Service define in particular:
a) rules for placing Orders,
b) conditions for concluding Sales Agreements,
c) rights and obligations of the Customer and the Seller.
5. To use the Store, a device with Internet access is required.
6. The Customer shall independently ensure access to the device and internet connection.
7. The Store is intended for adults, unless mandatory provisions of law provide otherwise.
8. The Terms of Service are available on the Store’s website in a manner allowing their content to be read.
III. Rules for using the Online Store
1. Account registration in the Store is voluntary. The Customer may place an Order without creating an account.
2. Placing an Order requires reading and accepting the Terms of Service.
3. The Seller may restrict or block a Customer’s access to the Store in case of violation of the Terms of Service, in particular where the Customer:
a) provided false data,
b) violated the rights of third parties,
c) acted contrary to law or good morals,
d) took actions detrimental to the Seller or other Customers.
4. The Customer is obliged to use the Store in a manner consistent with the law and these Terms of Service.
5. It is prohibited to provide unlawful content and to use the Store in a manner that disrupts its functioning.
IV. Conclusion of the Sales Agreement
1. The Customer places an Order by selecting Goods and adding them to the cart.
2. Until the Order is confirmed, the Customer may modify its content.
3. Placing an Order occurs after acceptance of the Terms of Service and clicking the button confirming the Order.
4. Information presented in the Store constitutes an offer within the meaning of Article 66 of the Civil Code.
5. The Sales Agreement is concluded at the moment the Seller accepts the Order for processing, confirmed by an email message.
6. The Sales Agreement is concluded in the Polish language.
V. Delivery
1. Delivery of Goods is carried out exclusively within the territory of the Republic of Poland.
2. Available delivery methods and their costs:
- InPost Courier – 15.99 PLN
- DPD Courier – 19.49 PLN
- InPost Parcel Locker – 14.49 PLN
- ORLEN Parcel – 12.49 PLN
- DPD Pickup – 11.99 PLN
3. The dispatch time is from 1 to 4 business days from the moment payment is credited.
4. In the case of agreements concluded with Consumers, the risk of accidental loss or damage to the Goods passes to the Consumer upon delivery of the Goods.
VI. Prices and payment methods
1. All prices are given in Polish zloty (PLN) and include all applicable taxes.
2. The available payment method is Przelewy24.
3. Orders are processed after prior payment confirmation. Payment is collected in advance before preparation and shipment of the Goods.
VII. Final provisions
1. In matters not regulated by these Terms of Service, the provisions of Polish law shall apply.
2. The Seller reserves the right to amend the Terms of Service for important legal or organizational reasons. Such changes shall not affect the acquired rights of Customers.
3. The Privacy Policy is available on the Store’s website.
